Swansea Bay Tidal Lagoon

Fish Legal has been representing Swansea Bay angling clubs, in particular Pontardawe & Swansea Angling Society (PASAS), in the seven years of extended planning inquiries (Development Consent Order and Marine Licence) into the ‘first of a kind’ Swansea Bay tidal hydropower proposal.

The £1.3 billion Swansea tidal lagoon project, which could have caused mortality of 20% or more to the salmon and sea trout using Swansea Bay, now seems to have finally reached the end of the road.

Granted a ‘nationally significant infrastructure project’ Development Consent Order (DCO) in 2015, the Government concluded in 2018 that the project would provide poor value for money compared with other renewables and refused to subsidise the high cost to consumers.

Although the developer attempted to keep alive the DCO pending its 30th June 2020 expiry by starting minor works on-site, both the Department of Business Energy & Industrial Strategy and Swansea Council have publicly stated – agreeing with local Fish Legal clubs’ representations – that these works were unlawful because significant pre-commencement conditions remained undischarged, and that the DCO has therefore now expired.
